Introduction


Quantizy LLC, the provider of the Quantizy app (“Quantizy”, “we”, “us”, “our”), values the privacy of individuals who use our websites and mobile applications and related products and services (collectively, our “Services”), and we are committed to protecting that privacy. This privacy policy (“Privacy Policy”, “Policy”) covers the information we collect when you visit, access, or use our Services, particularly the Personal Data as defined below. This Policy also describes the purposes for which we use such information, the steps we take to protect that information, and your choices regarding such information.

1. What Information We Collect


We collect information that alone or in combination with other information in our possession could be used to identify you (“Personal Data”) as described in this section:

Children

Our Services are not intended for anyone under the age of 13. If you are under 13, do not use or provide any Personal Data on or through our Services. If we learn we have collected or received Personal Data from a child under 13 we will delete that information. If you are a parent or guardian or otherwise believe we might have any Personal Data from or about a child under 13, please contact us so that we can delete the child’s Personal Data. The Services never knowingly accept, collect, maintain or use any Personal Data from a child under the age of 13.

Cookies

Cookies are small files that websites can save to your hard disk or to your browser’s memory. We may use them to track the number of visits to our Services, to analyze visitors’ use of our Services, and to store technical information useful for your interactions with our Services such as user preferences. We may use session cookies (cookies which expire upon logout) to store your user ID, elements of your user profile, and other information useful in running the session. You have the ability to accept or decline cookies. Please note that if you choose to decline cookies, you may not be able to experience the full functionality of our Services.

Communication Data

Anytime you contact us, or voluntarily respond to surveys or requests for market research, we may collect the information you send. It is optional which information you provide when you do so.

Demographic Data

We may collect your age, gender, and area of residence if you choose to provide them.

Device & Log Data

We automatically collect and store certain information in server logs when you use our Services. This may include details of how you used our Services, such as Internet protocol address, timestamps, device specific information (such as your hardware model, operating system version, unique device identifiers, and mobile network information including phone number), or system information such as crashes and error messages. We may associate your device identifiers with your account.

Health Data

We may collect your resting heart rate, weight, and sleep data, either directly from you or from a variety of sources such as Apple Health (HealthKit), Google Fit, Oura, Fitbit, and others, if you choose to provide such information. Notwithstanding anything else in this Privacy Policy, we use Health Data only to provide our Services and we will not disclose Health Data for advertising, marketing, or other purposes not necessary to provide our Services.

Identification Data

When you register for our Services, we collect your name, email address, phone number, account photo, and potentially other unique identifiers assigned by third party services (such as analytics or communication tools). If you sign up using credentials from a third party account such as Google or Facebook or Apple, we may collect your name and email address from the applicable third party.

Location Data

We may derive a rough estimate of your location from your IP address. We may also collect your GPS location from your devices if you choose to provide such information.

Social Media Data

We may have accounts on social media sites such as Instagram, Twitter, Facebook, Medium, and LinkedIn. When you interact with such social media accounts we may collect Personal Data that you elect to provide to us therein, such as your contact details. In addition, the companies that host our social media accounts may provide us with aggregate information and analytics about their activity.

Third Party Analytics

We use Google Analytics, a web analytics service provided by Google, Inc. (“Google”). Google Analytics uses cookies to help us analyze how users use the Site and enhance your experience when you use the Site. Timesheet Data and Other Manually Entered Data

In using our Services, registered users with Quantizy may voluntarily provide us with manually entered timesheet data (data similar to calendar entries with information such as a label, start timestamp, and end timestamp), potentially along with other information such as text (in labels, tags, or notes), contact details, geographic location, and audio, photo, or video recordings, to help them keep track of, and analyze, how they spend their time.

Usage Data

We may collect information about how you use our Services such as the features you use, the actions you take on the Services, and the time, frequency, and duration of your activities on the Services.

Web Beacons

Our Services also may contain electronic images known as web beacons – sometimes called single-pixel gifs – that allow us to count the number of users who have visited those pages. We may include web beacons in promotional e-mail messages or newsletters in order to determine whether messages have been opened and acted upon.

2. How We Use that Information


We may use your Personal Data internally in connection with our Services as follows in this section:

Business Operations

We may use your Personal Data to perform standard and ordinary business operations such as allowing you to set up an account; authenticating your access to the Services; maintaining and improving the Services and its many features; charging a monthly or annual subscription; personalizing certain features for you (for example, to update your Timesheet Data with timezones based on your Location Data); sending you push notifications through Apple or Android devices; analyzing and understanding how you use our our Services; developing new products and services based on your usage and feedback; contacting you and allowing other users to contact you; verifying your identity, age, and contact details; responding to or fulfilling your inquiries, comments, feedback, questions, or support requests; sending administrative notices to you (for example, security notices, changes to our terms, conditions, and policies, etc); and lastly, ensuring the security of our Services.

Marketing

We may use also your Personal Data to contact you to promote products or services that we believe may be of interest to you. For example, we may email you from time to time about new features or special offers. You may opt out of receiving such emails by following the instructions contained in any promotional email we send you.

3. Sharing and Disclosure of Information


We do not rent or sell your Personal Data in a personally identifiable form to anyone. We may share your Personal Data with certain third parties as described in this section:

Vendors and Service Providers

To assist us in performing necessary services and functions, we may share Personal Data with vendors and service providers, including providers of cloud hosting/computing services, database providers, email delivery and in-app/push messaging services, advertising and marketing services, payment processors, content monitoring services, and web, subscription, and app analytics services (together, “Providers”). Pursuant to our instructions, these parties will access, process, or store some amount of Personal Data in the course of performing their duties to us. We take commercially reasonable steps to ensure our Providers adhere to the security standards we apply to your Personal Data.

Agents

We may require the services of other agents who are not Providers such as contractors for software, design, marketing, or other skills (“Agents”) to maintain or improve our Services. We will take reasonable measures to check such agents’ backgrounds and business practices prior to engaging them with appropriate legal bindings. Once engaged, Agents may be granted restricted access to Personal Data as it exists in certain services run by Quantizy or our Providers, such as notification, email, or bug reporting services, and such access will be restricted as is reasonably necessary to carry out the work. No Agents will have unrestricted access to critical production infrastructure such as servers, databases, or backups.

Business Affiliates and Transfers

We may share your information with affiliates under common control with us, who are required to comply with the terms of this Privacy Policy with regard to your information. If Quantizy becomes involved in a business combination, securities offering, bankruptcy, reorganization, dissolution or other similar transaction, we may share or transfer your Personal Data in connection with such transaction.

Consent

Notwithstanding anything else in this Policy, in certain cases we may disclose your information with your explicit written permission.

De-Identified and Aggregated Information

We may create aggregated, de-identified or anonymous data from Personal Data by excluding or obfuscating certain information (such as your name, age, email address, or user ID) that makes the data unable to be identified or associated with you as an individual. For example, we might choose to disclose that 75% of Quantizy users track daily sleep activity with our Services, or that 30% of users in the state of New York have logged outdoor activities. Our use of aggregated, anonymized, or de-identified data is not subject to this Privacy Policy.

Legal Requirements

We may share your Personal Data with judicial processes or government agencies if required to do so by law or in the good faith belief that such action is necessary (i) to comply with a legal obligation, including to meet national security or law enforcement requirements, (ii) to protect and defend our rights or property, (iii) to prevent fraud, (iv) to act in urgent circumstances to protect the personal safety of users of the Services, or the public, or (v) to protect against legal liability.

Social Interactions with Other Users

Certain user profile information, including your name, location, and account photo, may be displayed to other users to facilitate social interaction within the Services. You can limit who can see your user profile and what information in your user profile is visible to others by managing your privacy settings. Please remember that any content you upload to your public user profile, along with any Personal Data or content that you voluntarily disclose online in a manner that other users can view (on discussion boards, comment threads, chat messages, etc.) becomes available to those other users, and might be collected or otherwise used by them.

4. How We Protect Information


Security

We implement appropriate technical and organizational safeguards to protect against unauthorized or unlawful processing of Personal Data and against accidental or unlawful destruction, loss, alteration, unauthorized disclosure of, or access to Personal Data. Please be aware, however, that we cannot fully eliminate security risks associated with the storage and transmission of Personal Data, particularly as much of our technical infrastructure is handled by third-party Providers. Although we employ reasonable protections for your information that are appropriate to its sensitivity, we cannot guarantee or warrant the complete security of the information you share with us and we are not responsible for the theft, destruction, loss or inadvertent disclosure of your information or content.

Data Retention

We keep Personal Data for as long as reasonably necessary for the purposes described in this Privacy Policy, while we have a business need to do so, or as required by law (e.g., to comply with our legal obligations, tax and accounting matters, dispute resolutions, etc), whichever is longer.

International Users and Data Transfers

The Personal Data we process is done so on servers in the United States. If you are located outside of the United States, please be aware that Personal Data we collect will be processed and stored in the United States. By using our Services and submitting your Personal Data, you agree to the transfer, storage, and/or processing of your Personal Data in the United States.

5. Managing Your Information (Your Choices and Rights)


In this section, we make you aware as to what control you have over the Personal Data we collect and what courses of action are available to you.

Marketing Communications

You can unsubscribe from our promotional emails via with a provided in such emails. Even when you opt-out of receiving promotional messages from us, you will continue to receive import administrative messages.

Accessing Personal Data

You can access your information by logging in to the Services and browsing the various screens provided.

Exporting Personal Data

You can export much of your data in CSV format from https://www.quantizylabs.com/auth/export. In order for that to work, you must have first verified your email with us so that we can safely send the CSV to the email listed on your account.

Limiting Personal Data

With the exception of automatically collected data such as Device & Log Data and Third Party Analytics Data, it is entirely within your control how much and what kind of data you wish to otherwise provide (Demographic Data, Timesheet and Other Manually Entered Data, Location Data, etc).

Updating or Deleting Personal Data

You can also update, correct, restrict, or delete much of your information by logging into your account and deleting particular individual data points or the entire account. Some information may remain in our records after your deletion of such information from your account. We may use any aggregated data derived from or incorporating your Personal Data indefinitely after you update or delete it, but not in a manner that would identify you personally.

6. California Privacy Rights Disclosures


Where provided for by law and subject to any applicable exceptions, California residents may have the following rights: to know the kinds of Personal Data that we have collected about you; to know the business purpose for collecting your Personal Data; to know the sources from which the Personal Data was collected; to access the individual points of Personal Data that we have collected about you; to know whether we have disclosed your Personal Data for business purposes, and the categories of Personal Data so disclosed, and the categories of any third parties to whom we have may disclosed your Personal Data; to have us under certain circumstances delete your Personal Data; and to be free from discrimination related to the exercise of these rights. If you would like to exercise any of these rights, you may do so either in the Services directly or by contacting us. Once we have received your request, we will verify your identity by sending an email to the email address you provide to us prior to taking the requested action.

7. European Union Rights


In order to comply with the requirements of the European General Data Protection Regulation (GDPR) for our European consumers and users, this Privacy Policy has outlined the legal basis on which we process your Personal Data and provide other information required by the GDPR. For the purposes of the applicable data protection laws, Quantizy LLC is the controller of the Personal Data collected here.

8. Links to other Sites


Our Services may provide a link, recommendations or otherwise provide access to to other websites not operated or controlled by Quantizy, including social media services (“Third Party Sites”). We provide these links merely for your convenience. We have no control over, do not review, and are not responsible for Third Party Sites, their content, or any goods or services available through the Third Party Sites. Our Policy does not apply to Third Party Sites, and any data you provide to Third Party Sites, you provide at your own risk. We encourage you to review the privacy policies of any Third Party Sites which you visit.

9. Changes to this Privacy Policy


The business and the service we provide may change from time to time. The laws and regulations that bind us might as well. As a result, we reserve the right to change this Policy at any time. When we do, we will post an updated version on this page, unless another type of notice is required by the applicable law. By continuing to use our Services after we have posted an updated Policy, or notified you by other means if applicable, you consent to the revised Privacy Policy.
